CHAPTER 12. PUBLIC PROPERTYCHAPTER 12. PUBLIC PROPERTY\Article 3. Chisholm Trail Recreation Commission

The city, pursuant to the authority granted to it by the statutes of the state and the vote of the majority of the voters of the city and Unified School District No. 264, joins with the school district to establish a recreation commission for the city and school district which shall be known as the Chisholm Trail recreation commission.

(a)   The Chisholm Trail recreation commission shall consist of five appointed members. The school district shall select one member who shall serve for a term of one year and one member who shall serve for a term of four years. The mayor, with the consent of the council, shall select one member who shall serve for a term of two years and one member who shall serve for a term of three years. The first four appointed members shall select a fifth member who shall serve a term of four years. Thereafter, the members shall be selected in the same manner as the member whose term has expired, and each subsequent appointment shall be for a term of four years.

(b)   Whenever a vacancy occurs in the membership, an elector shall be selected to fill the vacancy in the same manner as the member he is succeeding who shall serve for the unexpired term.

(c)   Beginning with the next selection by the mayor, at least one appointment to the recreation commission by the City of Clearwater must, at the time of their appointment, be an elected council member.

(d)   Beginning with the selection by the mayor following the appointment of an elected council member to the recreation commission pursuant to subpart (c) of this section, all appointments to the recreation commission by the City of Clearwater must reside within the city limits of the City of Clearwater, Kansas.

The recreation commission board shall elect a presiding officer and secretary. The commission is empowered to administer in all respects the business and affairs of the recreation system.

For purposes of financing the commission, the city shall levy the ad valorem taxes required by law and shall when received set over the sums collected pursuant to the levy to the commission. The commission shall use the funds for the purposes of establishing, maintaining and conducting a supervised recreation system for the city and school district and the funds shall be held by the treasurer of the school district who shall be the ex officio treasurer of the recreation commission. Members of the commission shall serve without pay.

All financial records of the recreation commission shall be audited as provided by K.S.A. 75-1122. A copy of the audit report prepared by the auditor shall be filed with the school district and the city.
