Charter Ordinance No. 12

A CHARTER ORDINANCE EXEMPTING THE CITY OF CLEARWATER, KANSAS, FROM THE PROVISIONS OF K.S.A. 1993 Supp. 79-5028, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISION ON THE SAME SUBJECT

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF CLEARWATER, KANSAS:

SECTION 1. The City of Clearwater, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas and as provided by K.S.A. 1993 Supp. 79-5036(a), hereby elects to exempt itself from the provisions of K.S.A. 1993 Supp. 79-5028. K.S.A. 1993 Supp. 79-5028 is part of an enactment commonly known as the Kansas property tax lid law, which enactment applies to this city but does not apply uniformly to all cities.

SECTION 2. The following is hereby added to the provisions of K.S.A. 1993 Supp. 70-5028. The provisions of K.S.A. 79-5021 to 79-5033, inclusive, and amendments thereto, shall not limit the levy of taxes by the Governing Body of the City of Clearwater for a Public Buildings Fund as authorized by K.S.A. 12-1736 to the extent of 4 mills for 10 years.
