A CHARTER ORDINANCE EXEMPTING THE CITY OF CLEARWATER, SEDGWICK COUNTY, KANSAS, FROM SECTION 79-5001 TO SECTION 79-5017, KANSAS STATUTES ANNOTATED AND ANY AMENDMENTS THERETO
WHEREAS, it is desirable to pass a Charter Ordinances exempting the City of Clearwater, Sedgwick County, Kansas, from the provisions of Section 79-5001 to Section 79-5017, inclusive, Kansas Statutes Annotated and any amendments there to, knows as the “Aggregate Tax Levy Limitations” law; and
WHEREAS, said section of such law do apply to said City of Clearwater but do not now apply uniformly to all cities.
NOW, therefore, be it ordained by the governing body of the City of Clearwater, Sedgwick County, Kansas.
3.04.030. That pursuant to the provisions of Section 5, Article 12 of the Constitution of the State of Kansas, the City of Clearwater, Sedgwick County, Kansas, hereby elects to exempt itself from and to make inapplicable to it Sections 79-5001 to 79-5017, inclusive, K.S.A. and amendments thereto which apply to said city, but the provisions of which do not apply uniformly to all cities in Kansas. The City of Clearwater, Kansas elects to modify the aforesaid sections as follows: beginning with the year 1981, said City may elect to increase the aggregate tax levy limitation (provided in K.S.A. 79-5001 et. Seq.) a total of not to exceed two mills. IN any year subsequent to the year 1981 said city may elect to further increase such levy limitation a total of not to exceed two mills; provided, however, that the entire increased aggregate tax levy for the City of Clearwater, Kansas, General Fund shall no exceed ten mills.
